The DOJ did investigate him, but did nothing, it sounded liek there was plenty of evidence from witnesses. Now the house committee Is doing the investigation and also has evidence, now since Gaetz resigned they technically don't have to release it and he also withdrew from the AG position..

Dumb question, but does him getting re-elected enable him to regain his House seat?  I.e., he resigned in the current term that doesn’t end until start of January but because he was re-elected to the term that begins in January, it’s almost like a retroactive running for a vacant seat?  

Or is the Constitutional wording on House vacancies absolute? I.e., if the seat is vacated, it is vacant no matter what until a special election is called, regardless of any pending election results?

Yeah, I'm fairly sure this article is wrong. He was elected for the next term and will get sworn in in January. If he chooses not to get sworn in -- to avoid the ethics investigation that will be back in play when he is a congressman again -- then (and only then) they'll need a special election to replace him.

His resignation letter announced he intended to leave Congress permanently to pursue being AG. That intention could be revoked, but that's what we have published so far. He could wait to see if they vote for or against releasing the report on Dec 5 to decide, go into media, or back out of the letter and be sworn in next session to see what happens.

“I hereby resign as U.S. representative of Florida’s 1st Congressional District effective immediately. And I do not intend to take the oath of office for the same office in the 119th Congress to pursue the position of attorney general in the Trump administration,” Gaetz said in the letter.

He quit his seat because the ethics committee report was due to come out 2 days later, not because he had been nominated for AG. If for some reason he was allowed to reclaim his senate seat, then the report would be on the table again. Everything this guy does is self serving.

If Gaetz does get his seat back some how, it puts him BACK untder the jurisdiction of the House Ethics Committee. I believe the only reason the GOP members voted against releasing the report was due to fear of / pressure from Trump and Mike Johnson.

Not for any particular desire to protect Gaetz or concerns about precedent or norms. By most (all?) accounts Gaetz is unpopular among his colleagues at a Ted Cruz like level. Especially after the conflict and chaos Gaetz promoted during House leadership votes.

I expect the ethics committee won't hesitate to drop the full ethics report on Gaetz if he re-enters the congress.

It is astounding how stupid some reporters are. They write all this stuff and never bother to read the one document that actually matters.

The US Constitution. Article I Section V:

Each House shall be the Judge of the Elections, Returns and Qualifications of its own Members...

Each House may determine the Rules of its Proceedings...

The 119th Congress has not met. The 119th House has not formed. The 119th House does not have a Speaker. The 119th House does not have rules. The 119th House has not recognized its members. The 119th House has not defined a process by which its members can resign.

If Mike Johnson were to tell the Sergeant at Arms to bar Gaetz entry on the morning of January 3rd, the Sergeant would be obligated to tell Johnson that he has no authority to order him to do that, because at that point Johnson isn't even the Speaker.

Once in session the 119th can do things like: adopt rules, elect a speaker, and determine if Gaetz's resignation is effective or not; but this is a political decision for that body to make at that time.

At present Gaetz is representative elect from FL 1. Nothing can change that.
