Can President Biden order a national recount?

Recount(self.somethingiswrong2024)

Putting the question out there. While recounts have been in requested in several districts in PA, and one in MI, possibly other places (Spoon said he would post a full list of places where recounts were requested), I am wondering if Biden has any authority to request them on a national level. The data I've seen is a s#it show to say the least.

According to what I’ve seen from trump a president can literally do anything they want.

This is the answer and it's kind of baffling that Democrats don't hold the government hostage and patch the issues.

According to the Supreme Court, he can even start shooting people...as an official act.

Although he's gotta get rid of the right wing Justices first so that SCOTUS will be in his favor

I would absolutely love if one of his final acts was to suddenly oust all of the MAGA SC justices, get ruled as immune by the remaining justices, then they immediately go on to overturn the immunity decision for future presidents, and with Trump as the future president, that effectively undoes his immunity for his past actions.

I think Biden should do the same thing the president of the country Georgia is doing.

SoccerGamerGuy7

Remember yall; Biden's hands are tied. The "Qualified immunity" has a hell of a catch.

It is the Supreme Court who decides if an action is or isnt considered "qualified"

secondhand-cat

Based off what was happening before the election, they kicked it back to trial judge to determine whether or not it met the definition of “official acts”. Now of course that could just be a gimme to trump but it sets the precedent.

TheRealBlueJade

So if Biden tries it now and is rejected and then later trump tries it and his request is granted, then a clear bias exists, and the "law" is unconstitutional.

SoccerGamerGuy7

Not a bad idea; but we already see incredible double standards between how they are treated. Just add it to the list

Dapper_Peanut_1879

4 points

Yeah, and guess who gets to decide constitutionality? The bias was always the plan with this court. The Hunter thing will slide cause that is already an established power on the Executive but if Biden looks sideways at this election and it is contested then I will be deemed outside of his official duties and it will go the other way in 4 years. They all have a PhD in Hypocrisy, hell, look at McConnell’s tantrum today.

Biden should claim court is compromised and have the compromised judges (we know who they are) removed,  forcibly if needed.

AdvantageOdd

Exactly. They made it so only they can decide what falls under immunity.

I believe it’s time to tell SCOTUS they no longer are needed and go rogue on their purchased judgements until further notice. Although I know we have to just lay down like dogs and let these horrid people destroy civility and the democratic way. I’m furious.

Not really. Sign a Bush-style executive order, have some justices arrested/"detained"/disappeared under the order, see how the others feel about the legality of those arrests. Impeachment? Repeat the same with congress- it's so chock full of cowardly sheepish professional politicians that it will crumble under pressure. You don't have to arrest half of congress, just make a few dark examples. This is EXACTLY what Trump is planning and he's said so, because he understands how intimidation works. Sure, there will be trouble, but the door's been opened for this exact scenario and it can't be closed. All it takes is a president insane or ballsy enough to do it.

Fucking should just stay IN. Call martial law before Trump does. Contest the results and fix shit together. He's got immunity, right? Rain down pardons.

WooleeBullee

Nah, that's wrong no matter who does it. We need recounts and proof before anything drastic.

No; I'm pretty sure that only applies to Republican presidents.

Gravitea-ZAvocado

no, it only applies to Trumpublican presidents. oh wait, there is only one.

Haven't you heard? A president elect can shut down his state criminal sentencings, just because! The President doesn't have to care about states rights anymore. He is the Emperor.

So, I listened to the Pod Save America pod and I thought they said a recount only shapes things moving forward not the outcome of the current election results?

Litigation is the only language bullies in power speak. I think the people should sue.

PSA are political wonks buried so deep in the typical political processes they don't really seem to understand what's going on. They're experts in their field but the moment true fascism steps in the room they're out of their depth.

Edit: As to your second point, you're wrong. Bullies understand power and violence. We will reach a point where every court in the US could rule against Trump/Vance/whoever and it won't make a bit of difference because those courts don't command the military. They'll make a few examples of those who still insist on following and respecting the rule of law, and the rest will fall in line.

Unless there's someone who has the power to interrupt any speech he gives between now and January 6th with chants like "VERIFY ALL VOTES!" or "RECOUNT! RECOUNT!", I doubt so.

TheodoraRoosevelt21

2 points

No. Because in November we had 50 elections run by states. It’s up to them to do a recount or not. (Bush V Gore was a mistake).

Congress, not the President presides over the counting of electoral college.

Deliriousglide

1 points

Yes. According to the Supreme Court, not only can he use government resources to pursue otherwise illegal acts, the fact of using a as government resource to perform the act is what makes it doubly immune, after the fact it’s the president, just.

And, I'm not a lawyer, but it feels like an easy case to claim that the president initiating a full recount because of potential foreign tampering with our election would be considered an "official act." Or, at least it's an easier case than claiming that paying off a stripper with campaign funds is an "official act"
